These Terms of Service (“Terms”) govern your use of the Clínica Médica Salve / Clinica Medica Salve PLLC website and related digital tools, including Salve Assist chat, treatment planner, online booking requests, patient intake portals, electronic signature portals, and linked financing information (together, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy & Notice of Privacy Practices.

1. The Practice

Clínica Médica Salve (Clinica Medica Salve PLLC) is a family medicine organization serving patients at 217 W Main St, Suite 110, Grand Prairie, TX 75050 (NPI 1982346631). Public records list Dr. Espiridion Mendez, D.O., as Director/authorized official. We offer primary/family care and also weight-management, BIOTE hormone-related services, and nonsurgical aesthetic services (such as neuromodulators/fillers/Sculptra, HydraFacial, and laser) as available and clinically appropriate.

2. Acceptance & eligibility

By using the Services you represent that you are at least 18 years old, or that you are a parent/legal guardian using the Services on behalf of a minor patient and you have authority to do so. If you do not agree to these Terms, do not use the Services.

3. Not medical advice; no doctor–patient relationship from the website alone

Content on the website, Salve Assist replies, treatment-planner suggestions, service descriptions, and educational materials are for general information and visit preparation only. They are not a diagnosis, prescription, or personalized medical advice.

Using the website, submitting a booking request, completing intake, or chatting with Salve Assist does not by itself create a physician–patient (or practitioner–patient) relationship. In Texas, a clinical relationship for medical care — including nonsurgical cosmetic procedures that constitute the practice of medicine — is established through an appropriate good-faith examination and clinical evaluation by a licensed physician, PA, or APRN (in person or via compliant telemedicine when applicable), not by marketing tools alone.

Final recommendations, dosing, product selection, and suitability for Botox/fillers/laser/hormone therapy/weight-management medications are made only after clinical evaluation by licensed professionals under Texas Medical Board rules and clinic protocols.

Emergencies: If you have a medical emergency, call 911 or go to the nearest emergency department. Do not rely on website forms, chat, or email for urgent care.

4. Aesthetic & med-spa style services (Texas)

Nonsurgical cosmetic procedures (including injection of medications or substances for cosmetic purposes and use of certain prescription devices/lasers) are the practice of medicine in Texas and are regulated by the Texas Medical Board. Before treatment you should expect:

  • Establishment of a practitioner–patient relationship and documentation in the medical record
  • A good-faith exam (history, appropriate exam, assessment, and plan) by a physician, PA, or APRN — which may be in person or via compliant synchronous telemedicine when appropriate
  • Procedure-specific informed consent describing material risks, benefits, alternatives, and who will perform the procedure under delegation/protocols
  • Appropriate supervision/availability of a physician for delegated acts as required by TMB rules

Results vary. Before-and-after expectations discussed online are illustrative only. Photos or planner “hotspots” you select help us prepare; they are not a guarantee of a particular aesthetic outcome.

5. Weight-management & medications

Our medicated weight-loss program, if offered to you, requires clinical evaluation, ongoing follow-up, and may involve FDA-approved medications and/or other therapies as clinically appropriate. Individual results vary. We do not guarantee a specific amount of weight loss or timeframe.

If compounded medications are ever considered for a patient-specific need, compounded drugs are not FDA-approved and are not the same as FDA-approved brand products. We do not claim that any compounded product is a “generic,” “equivalent,” or “the same as” branded drugs such as Ozempic®, Wegovy®, Mounjaro®, or Zepbound®. Medication choices are made by licensed clinicians with patient-specific informed consent.

Website marketing that mentions weight loss is educational/administrative and subject to FTC truth-in-advertising standards. Always discuss risks, contraindications, and monitoring with your clinician.

6. BIOTE / hormone-related care

BIOTE and related hormone services are offered as clinically indicated after evaluation (history, labs when appropriate, and shared decision-making). Hormone therapy involves risks and benefits that will be reviewed with you. Website descriptions do not guarantee energy, mood, libido, weight, or other outcomes.

7. Booking requests, intake, planner & Salve Assist

  • Booking forms request an appointment; submission is not a confirmed appointment until the clinic confirms date/time.
  • Intake portals collect consents and health information to prepare for care; incomplete or inaccurate information may delay or limit treatment.
  • The treatment planner helps you mark concerns; it is a communication aid, not a surgical or injectable prescription.
  • Salve Assist is a guided clinic workflow (rules-based guidance tied to our services). It may suggest next steps (book, finance, planner) but cannot replace clinical judgment.

You agree to provide accurate information and to update it when it changes. You authorize us to contact you about your request through the phone, SMS, and email channels you provide, consistent with our Privacy Notice and applicable consent laws (including TCPA for automated texts where required).

8. Electronic signatures & records

By typing your name or otherwise signing electronically on intake, consents, or contracts, you intend to sign and agree that the electronic signature has the same legal effect as a handwritten signature under the U.S. ESIGN Act, UETA (as adopted), and applicable Texas law, to the extent permitted.

You agree that we may retain electronic records of your submissions, consents, and signatures as part of your clinic file and for compliance retention periods.

9. Financing (CareCredit, Cherry, and similar)

Links to CareCredit, Cherry, or other financing partners are provided for convenience. Those companies are independent third parties. Credit decisions, interest rates, fees, and contracts are solely between you and the financing company under their terms and privacy policies. We do not guarantee approval or any particular payment plan.

10. Fees, insurance & self-pay

Service availability, fees, and insurance participation change over time. Aesthetic and many cash-pay services may not be covered by insurance. You are responsible for understanding your coverage and for balances due for services you receive. Quotes given before clinical evaluation are estimates only.

11. Acceptable use

You agree not to:

  • Misrepresent your identity or authority to act for a patient
  • Upload malware, scrape the site abusively, or attempt unauthorized access to systems or other patients’ data
  • Harass staff or other users through forms, chat, or messaging
  • Use the Services for any unlawful purpose
  • Reproduce or republish substantial site content for commercial use without permission

We may suspend or terminate access to digital tools for abuse, security risk, or legal compliance.

12. Intellectual property

The Clínica Médica Salve name, logo, website design, copy, videos, and graphics are owned by the Practice or its licensors. BIOTE®, HydraFacial®, CareCredit®, Cherry®, and other third-party marks belong to their owners. You may not use our branding in a way that implies endorsement without written permission.

13. Third-party links & social media

Our site may link to Google Maps, Facebook, Instagram, financing partners, and other external sites. We are not responsible for their content, availability, or privacy practices. Reviews or comments you post on social platforms are subject to those platforms’ terms.

14. Privacy

Health and personal information you submit is handled as described in our Privacy Policy & Notice of Privacy Practices, including HIPAA and Texas HB 300 requirements. Please review that Notice carefully.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms limits any non-waivable rights you have under Texas or federal law as a patient, including rights related to informed consent for clinical care actually provided.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRACTICE AND ITS OWNERS, CLINICIANS, AND STAFF WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR DIGITAL TOOLS. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE WEBSITE/DIGITAL SERVICES (AS DISTINCT FROM PROFESSIONAL LIABILITY FOR CLINICAL CARE, WHICH IS GOVERNED BY APPLICABLE MALPRACTICE LAW) SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US SPECIFICALLY FOR THE DIGITAL FEATURE AT ISSUE, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the Practice and its workforce from claims arising out of your misuse of the Services, your submission of false information, or your violation of these Terms — except to the extent caused by our willful misconduct or as prohibited for patient professional-liability claims.

18. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and applicable federal law. Exclusive venue for disputes arising from the website/digital Services (not clinical malpractice claims, which follow applicable Texas medical-liability procedures) shall be state or federal courts located in Texas covering Dallas County / Tarrant County as appropriate, unless law requires otherwise.

19. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the Services after posting constitutes acceptance of the updated Terms, except where additional consent is required by law.

20. Miscellaneous

  • Severability: If any provision is unenforceable, the rest remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver of future enforcement.
  • Entire agreement: These Terms plus the Privacy Notice and any signed clinical consents/contracts form the agreement for the subjects they cover.
  • Assignment: We may assign these Terms in connection with a practice sale or reorganization; you may not assign without our consent.
